Terms of Use

Effective date: June 10, 2026. These terms govern your use of the VINSwift mobile application and website.

1. Acceptance of these terms

VINSwift is an independently developed application based in Ontario, Canada. In these Terms, “we,” “us,” and “our” refer to the developer of VINSwift.

By downloading, accessing, or using VINSwift, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use VINSwift.

2. What VINSwift provides

VINSwift provides tools for scanning VINs, requesting decoded vehicle information, and sharing reports. It may also store local vehicle records and allow users to attach photos and notes. Features may change, be interrupted, or be discontinued.

3. Vehicle data limitations

Decoded vehicle information is primarily provided through the NHTSA vPIC service and may be incomplete, unavailable, delayed, or inaccurate. VIN recognition from barcodes, photos, or manual entry may also produce errors. You are responsible for confirming every VIN and all vehicle information before relying on it.

VINSwift is not a vehicle-history report, title search, safety inspection, appraisal, warranty, ownership verification, or substitute for professional judgment. VINSwift does not determine whether a vehicle is stolen, damaged, recalled, safe, legally transferable, or suitable for any purpose.

4. Your responsibilities

You agree to use VINSwift lawfully and responsibly. You are responsible for obtaining any permission required to photograph a vehicle, record information, or share a report. You must not use VINSwift to violate privacy, property, intellectual-property, consumer-protection, or other rights.

You are responsible for reviewing captured and decoded information, maintaining device security and backups, protecting shared reports, and deciding whether information is appropriate to share.

5. Local storage and data loss

VINSwift currently stores vehicle records, notes, and photos locally on your device. Records may be lost if you delete them, delete the app, lose or damage the device, change devices, or experience a software or storage failure. We do not guarantee recovery or backup of local records. Maintain separate records when the information is important.

6. Third-party services

VINSwift may use or interact with third-party services, including NHTSA vPIC, Amplitude, app stores, operating-system services, and apps selected through your device’s native share sheet. Third-party services are governed by their own terms and policies. We are not responsible for third-party services, availability, content, or conduct.

7. Intellectual property

VINSwift’s software, design, branding, and original content are owned by its developer or applicable licensors and are protected by applicable laws. These terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use VINSwift for its intended purpose. They do not transfer ownership or permit you to copy, modify, distribute, sell, reverse engineer, or exploit VINSwift except where applicable law expressly allows it.

You retain ownership of photos, notes, and other content you create. You grant the developer only the permissions technically necessary to process that content on your device and perform actions you request, such as sharing.

8. Prohibited use

You may not misuse VINSwift, interfere with its operation, bypass security or access controls, introduce malicious code, use automated systems to overload third-party services, impersonate others, or use VINSwift in a way that violates law or these terms.

9. Disclaimers

VINSwift is provided “as is” and “as available.” To the maximum extent permitted by law, the developer disclaims all warranties, express or implied, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that VINSwift or decoded vehicle data will be complete, error-free, secure, or continuously available.

10. Limitation of liability

To the maximum extent permitted by law, the developer of VINSwift and applicable service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, vehicle value, business, or opportunities arising from or related to VINSwift.

To the maximum extent permitted by law, the developer’s total liability for claims relating to VINSwift will not exceed the greater of the amount you paid for VINSwift during the twelve months before the claim or USD $25. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Nothing in these Terms limits any rights or remedies that cannot be limited or excluded under applicable law.

11. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the developer of VINSwift and applicable service providers from claims, losses, liabilities, and expenses arising from your misuse of VINSwift, your content, your shared reports, or your violation of these terms or applicable law.

12. Suspension and termination

You may stop using VINSwift at any time. We may suspend or terminate access to VINSwift where reasonably necessary to protect the service, users, third parties, or legal rights. Sections that by their nature should survive termination will survive.

13. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to VINSwift or these Terms that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14. Changes to these terms

We may update these terms as VINSwift changes. Revised terms will be posted on this page with an updated effective date. Continued use after revised terms take effect means you accept them, where permitted by law.
